MI Probate and Estate Navigator, PLC

Effective Date: March 26, 2026  |  Website: miprobatenav.com

These Terms of Service govern access to and use of miprobatenav.com and the related services offered by MI Probate and Estate Navigator, PLC.

Please review these Terms carefully before using the Site, submitting information, placing an order, or requesting filing assistance.

1. Acceptance of Terms

By accessing or using the Site, communicating with us through the Site, or purchasing any service through the Site, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Site or services.

2. Description of Services

The Site is intended to help users identify the appropriate probate or estate path, obtain the correct forms for the estate type selected, receive guidance about the filing process, and, when offered and selected, request filing assistance. Services may include intake, document preparation support, administrative workflow guidance, customer communications, and filing support.

3. No Attorney-Client Relationship by Site Use Alone

Viewing the Site, submitting an inquiry, or purchasing standard form-assistance or filing-guidance services does not by itself create an attorney-client relationship, legal representation, or a duty to provide individualized legal advice. If legal services are separately offered, any attorney-client relationship must be established by a separate written engagement agreement. In the event of a conflict between these Terms and a separate signed engagement agreement, the signed engagement agreement will control to the extent of the conflict.

4. User Responsibilities

You are responsible for providing complete, current, and accurate information. You are also responsible for reviewing the information, forms, and filing package prepared from the information you submit. We may rely on the information you provide, and we are not responsible for delays, rejections, or other issues caused by incomplete, inaccurate, inconsistent, or outdated customer information.

5. Approval, Signatures, and Filing Authorization

Before any filing is submitted on your behalf, you are responsible for reviewing and approving the forms. If a particular form requires a signature, you are responsible for supplying the required signature. By selecting a filing service, you authorize us to transmit only those forms that you have approved and/or signed, as applicable to the filing requirement, to the appropriate court or filing office. Not all forms require a signature before filing.

6. Turnaround Times

Any turnaround time stated on the Site, in marketing, or in communications — including references to same-business-day service — is an estimate only, not a guarantee. Actual timing depends on the completeness of the information submitted, responsiveness to questions or approval requests, payment confirmation, service demand, court or filing office hours, technology issues, and other circumstances outside our reasonable control.

7. Fees and Payment

Service fees, if any, will be disclosed through the Site, checkout process, quote, or written communication. By placing an order, you agree to pay the stated fees and any applicable taxes or filing charges. Unless otherwise stated in writing, court filing fees and other third-party charges are separate from our service fees. Refund eligibility, if any, is governed by any posted refund policy, specific order terms, or applicable law.

8. Electronic Communications

By using the Site and providing contact information, you consent to receive electronic communications from us regarding your inquiry, order, approvals, signatures, filing status, service updates, and related matters. You are responsible for monitoring your email and other communication channels you provide to us.

9. Permitted and Prohibited Uses

You may use the Site only for lawful purposes related to seeking information about our services or obtaining services from us. You may not:

  • use the Site in violation of any law or court rule;
  • submit false, misleading, or unauthorized information;
  • attempt to interfere with the operation or security of the Site;
  • copy, scrape, reproduce, or exploit Site content beyond ordinary personal use without written permission; or
  • use the Site in a way that could harm the Company, its customers, or third parties.

10. Intellectual Property

The Site, including its text, graphics, layout, branding, and original content, is owned by or licensed to the Company and is protected by applicable intellectual property laws. You receive no ownership interest in the Site or its content through your use of the Site or purchase of services, except for your rights in information and documents you provide.

11. No Guarantee of Court Acceptance or Outcome

We do not guarantee that any court, clerk, judge, or filing office will accept a filing, act on it within a particular timeframe, or reach any particular result. Filing requirements, local practices, and court procedures may vary. You remain responsible for reviewing all filings and for any deadlines, hearing requirements, service obligations, or follow-up steps unless a separate written agreement expressly states otherwise.

12. Disclaimer of Warranties

To the fullest extent permitted by law, the Site and services are provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability. We do not warrant that the Site will always be available, error-free, or secure.

13. Limitation of Liability

To the fullest extent permitted by law, the Company will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to the Site or services. To the fullest extent permitted by law, the aggregate liability of the Company for any claim arising out of or relating to the Site or services will not exceed the amount actually paid by you to the Company for the specific service giving rise to the claim during the six months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless the Company and its owners, attorneys, employees, contractors, and agents from and against claims, losses, liabilities, costs, and expenses arising from your misuse of the Site, your violation of these Terms, or your submission of false, inaccurate, unauthorized, or infringing information or documents.

15. Third-Party Services and Links

The Site may reference or link to third-party services, including court resources, government websites, payment processors, or technology providers. We are not responsible for third-party content, systems, downtime, or policies, and use of third-party services may be governed by their own terms and privacy policies.

16. Suspension or Termination

We may suspend or terminate Site access or decline service, with or without notice, if we believe a user has violated these Terms, provided false information, created a security risk, engaged in abusive conduct, or requested a service we cannot provide appropriately.

17. Governing Law and Venue

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law rules. Any dispute arising out of or relating to the Site or these Terms shall be brought in a state or federal court of competent jurisdiction located in Michigan, unless a different forum is required by a separate written agreement or applicable law.

18. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted to the Site with a revised effective date. Continued use of the Site after the effective date of revised Terms constitutes acceptance of the updated Terms to the extent permitted by law.
